Please read these Terms of Use ("Terms") carefully before using Frame Picker By Kriss ("the App") developed by Kriss ("we", "us", or "our").

By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

1. License Grant

1.1 Limited License

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on macOS devices that you own or control, for your personal, non-commercial purposes.

1.2 Restrictions

You may not:

  • Copy, modify, or distribute the App
  • Reverse engineer, decompile, or disassemble the App
  • Rent, lease, lend, sell, or sublicense the App
  • Remove, alter, or obscure any proprietary notices
  • Use the App for any illegal purpose
  • Use the App to infringe on the rights of others

2. App Store Terms

The App is distributed through the Apple App Store. Your use of the App is also subject to:

In case of conflict between these Terms and Apple's terms, Apple's terms shall prevail with respect to your use of the App.

3. In-App Purchases

3.1 Free Version

The App offers limited functionality for free:

  • 5 frame exports total
  • JPEG Low quality format only

3.2 Full Version Purchase

A one-time in-app purchase unlocks the full version with:

  • Unlimited frame exports
  • All export formats (PNG, TIFF, WebP, JPEG at all quality levels)

3.3 Payment

  • All payments are processed by Apple through the App Store
  • Prices are displayed in your local currency
  • Purchases are final and non-refundable except as required by law
  • For refund requests, please contact Apple Support

3.4 Restore Purchases

You can restore previously purchased content on any device signed into the same Apple ID using the "Restore Purchases" feature in the App.

4. Intellectual Property

4.1 Ownership

The App and all related content, features, and functionality are owned by Kriss and are protected by copyright, trademark, and other intellectual property laws.

4.2 Trademarks

"Frame Picker By Kriss" and associated logos are trademarks of Kriss. You may not use these trademarks without prior written permission.

4.3 Your Content

You retain all rights to:

  • Videos you open in the App
  • Frames you extract and export
  • Project files you create

We claim no ownership or rights over your content.

5. User Responsibilities

5.1 Legal Use

You agree to use the App only for lawful purposes and in compliance with all applicable laws and regulations.

5.2 Content Rights

You represent and warrant that you have the necessary rights to:

  • Open and process videos in the App
  • Extract and export frames from those videos
  • Use the exported content as intended

5.3 Copyright Compliance

You are solely responsible for ensuring your use of the App does not infringe on the copyrights or other intellectual property rights of third parties.

6. Disclaimer of Warranties

6.1 "As Is" Basis

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

6.2 No Warranty

TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

  • MERCHANTABILITY
  • FITNESS FOR A PARTICULAR PURPOSE
  • NON-INFRINGEMENT
  • ACCURACY OR RELIABILITY
  • UNINTERRUPTED OR ERROR-FREE OPERATION

6.3 No Guarantee

We do not warrant that:

  • The App will meet your requirements
  • The App will be uninterrupted, timely, secure, or error-free
  • Results obtained from the App will be accurate or reliable
  • Any errors in the App will be corrected

7. Limitation of Liability

7.1 Exclusion of Damages

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL WE BE LIABLE FOR ANY:

  • INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
  • LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES
  • DAMAGES RESULTING FROM YOUR USE OR INABILITY TO USE THE APP
  • DAMAGES RESULTING FROM ANY CONTENT OBTAINED FROM THE APP
  • UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR TRANSMISSIONS OR DATA

7.2 Liability Cap

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE APP IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

7.3 Jurisdictional Limitations

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES OR LIMITATION OF LIABILITY. IN SUCH JURISDICTIONS, OUR LIABILITY SHALL BE LIMITED TO THE GREATEST EXTENT PERMITTED BY LAW.

8. Indemnification

You agree to indemnify, defend, and hold harmless Kriss and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising out of or in any way connected with:

  • Your use of the App
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Your content processed through the App

9. Updates and Changes

9.1 App Updates

We may release updates to the App from time to time. Updates may:

  • Add, modify, or remove features
  • Fix bugs or security issues
  • Change system requirements

9.2 Terms Updates

We reserve the right to modify these Terms at any time. Changes will be effective when posted. Your continued use of the App after changes constitutes acceptance of the new Terms.

10. Termination

10.1 Your Rights

You may stop using the App at any time by uninstalling it from your device.

10.2 Our Rights

We may terminate or suspend your access to the App immediately, without prior notice, if you breach these Terms.

10.3 Effect of Termination

Upon termination:

  • Your license to use the App ends
  • You must delete all copies of the App
  • Provisions that by their nature should survive will remain in effect

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of France, without regard to its conflict of law provisions.

12. Dispute Resolution

12.1 Informal Resolution

Before filing any legal claim, you agree to first contact us and attempt to resolve the dispute informally.

12.2 Jurisdiction

Any disputes arising from these Terms or your use of the App shall be subject to the exclusive jurisdiction of the courts of France.

13. General Provisions

13.1 Entire Agreement

These Terms constitute the entire agreement between you and us regarding the App and supersede all prior agreements.

13.2 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in effect.

13.3 Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

13.4 Assignment

You may not assign or transfer these Terms without our prior written consent. We may assign our rights and obligations without restriction.

15. Apple-Specific Terms

As required by Apple, you acknowledge and agree that:

  1. These Terms are between you and Kriss only, not Apple
  2. Kriss, not Apple, is solely responsible for the App and its content
  3. Apple has no obligation to provide maintenance or support services
  4. Apple is not responsible for any product warranties
  5. Apple is not responsible for addressing any claims relating to the App
  6. Apple is a third-party beneficiary of these Terms

By using Frame Picker By Kriss, you acknowledge that you have read, understood, and agree to be bound by these Terms of Use.
